Amendments to the ERISA

COBRA, or the Consolidated Omnibus Budget Reconciliation Act, is an amendment to the Employee Retirement Income Security Act that gives workers and their families who lose their health benefits the right to choose to continue group health benefits provided by their group health plan. Such individuals and their families are allowed to do this for limited periods of time under certain circumstances such as voluntary or involuntary job loss, reduction in the hours worked, transition between jobs, death, divorce, and other life events.

Costs and Requirements

Workers and employees who qualify may be required to pay the entire premium for coverage up to 102 percent of the cost to the plan. The amendment requires that group health plans sponsored by employees with 20 or more employees in the prior year offer employees and their families the opportunity for a temporary extension of health coverage for certain situations in which coverage under the plan would otherwise end.

Health Insurance Portability and Accountability Act

This amendment provides rights and protections for participants and beneficiaries in group health plans. Employees are protected for coverage under group health plans that limit exclusions for preexisting conditions. HIPAA also prohibits discrimination against employees and dependents based on their health status.
